  • New lawsuit hits SocGen over fraud scandal
PARIS (Reuters) - A French lawyer acting for 100 small shareholders said on Monday he had sued French Societe Generale over the way it unbundled billions of dollars in allegedly fraudulent share deals earlier this week. Frederik-Karel Canoy said the bank should have informed markets about its pending losses before embarking on a massive selling spree on Monday to Wednesday to unwind the 50 billion euros of uncovered futures positions built up by trader Jerome Kerviel. Canoy told Reuters he had also filed a separate complaint about the sale of a million shares by a SocGen director of shares on January 9 and 10, disclosed in a filing. Both complaints allege insider dealing and market manipulation, he said. A SocGen spokesmwoman said the director, Robert A. Day, had sold shares "well before" the bank became aware of alleged fraud carried out by one of its traders, leading to heavy losses. Canoy is already suing SocGen for negligence over the fraud.

Nearly 100 residents of Endicott—the birthplace of IBM—and the neighboring town of Union have filed a toxic tort lawsuit against the company, claiming that contamination from a local IBM plant caused health problems and property devaluation.Decades of Contamination"This is contamination involving toxic contamination in the groundwater that then through vapor intrusion got into people's homes. And it's contamination we believe has been there back into the 1960s," said attorney Stephen Schwarz. However, the contamination was not known until 2003 and now the contamination is being cited as the source of cancer, birth defects and other ailments suffered by local residents.Compensating Victims Attorneys for the plaintiffs say they "have one simple goal, to get reasonable compensation for the injuries our clients have sustained."More lawsuits against the company are expected to follow in the coming months on behalf of about 900 Endicott and Union reside
  • Sienna Miller wins naked photo lawsuit against photog
Sienna Miller has won a high court privacy order over nude photos taken while she was on the set of her new film.   Photographer Warren Richardson took photos of the actress with a long lens on the closed set of Hippie Hippie Shake without her consent.   At a hearing at London's High Court, Justice Eady granted a permanent injunction against Richardson after Miller claimed that the naked pictures were taken without her permission.   The candid pictures were later sold by Richardson’s employer, Xposure Photo Agency, to British tabloids The Sun and the News of the World, which published them in October, reports Contactmusic.   However, a judge ruled in her favour and Miller was given 75,000 dollars in damages in an invasion of privacy lawsuit filed against the photo agency and the publications' parent company, News Group Newspapers.   The judge ruled that it was "entirely appropriate" to make the orders sought against the photographer.   H

  • Beyonce Knowles wins copyright infringement lawsuit
R&B singer Beyonce Knowles has won a copyright infringement lawsuit against an unknown songwriter who had claimed the star stole her song to create her 2003 hit ‘Baby Boy’.   Jennifer Armour claimed that she had sent her track for consideration to Mathhew Knowles, Beyonce’s father and manager in 2003.   However, a U.S. judge ruled in 2006 that there was no evidence to suggest that the former Destiny’s Child singer had copied a demo recording of the track by Armour.   Armour appealed against the ruling last year but again the judge ruled in favour of Beyonce after being satisfied by evidence showing that the singer had already finished her song when Armour submitted her track.   A statement released on Jan 2, 2008 said that the United States Court of Appeals for the Fifth Circuit "upheld the 2006 trial court decision dismissing a copyright infringement lawsuit brought against Beyonce".   Beyonce is pleased that the whole c
  • DiCaprio’s neighbours need to do more to back their shaky lawsuit
Leonardo DiCaprio’s neighbours have been given 15 days to amend their lawsuit against the Titanic star, for alleged destabilization of their property.   Judge Tricia Ann Bigelow said that the lawsuit lacked in detail and failed to show that DiCaprio was responsible for the destabilization, and thus gave a deadline for them to change its details.   The actor was sued by his neighbours, who claimed property damages after Di Caprio built a basketball court in his Los Angeles property.   Ronald and Joan Linclau filed a lawsuit against the actor in May 2007, alleging that DiCaprio "maliciously" cut and removed hedges; excavated "earth, granite and bedrock", destabilizing their deck and swimming pool; and ignored their repeated requests to stop the construction, reports Contactmusic.   The couple was seeking around 250,000 dollars in damages if Di Caprio proves guilty. • Activision Facing Class Action Lawsuit Over GHIII - SendMeRSS
Activision Facing Class Action Lawsuit Over GHIIIThe makers of Guitar Hero III seem to have stepped into a legal hornet’s nest lately. Not long after a lawsuit arose regarding the cover version of a song by The Romantics,  has been filed against them. The issue is the fact that despite advertising stereo sound and Dolby Pro Logic II surround-sound on both the box and the manual, the Wii version of Guitar Hero III only outputs mono sound. The company had already made plans to deal with this problem by remastering and reissuing the game to purchasers free of cost. It seems they didn’t act quickly enough or decisively enough however, as the complaints addressed in the filing include the fact that the game has still been on the shelves since the issue was noticed and that no action had been taken to warn consumers of the disparity between the advertising and the actual features of the game. The suit seeks to have the money spent by consumers refunded and to strip the profits f

  • Dumb Lawsuit
Image courtesy flickr user Tomswift46 Dr Robert Woo, of Auburn near Washington, sounds like a fun boss. The oral surgeon played a practical joke on his assistant by implanting fake boar tusks in her mouth while she was under anesthesia. The dentist then took photos of her and shared them around the office. The employee, Tina Alberts, felt humiliated and quit, later suing her boss. When Woo’s insurance company wouldn’t cover the lawsuit, he settled out of court with Alberts for US$250,000. He then sued the insurers and was awarded US$750,000, plus the US$250,000 he had already paid. (Source: nbc4.com) via sideswipe Posted by . r o s s .
  • Unity08 Loans: So Why the Lawsuit?
As I noted yesterday, $460,000.00 — a majority amount of all contributions to Unity08 in the first six months of 2007 — came from just three rich and powerful people. $450,000.00 of that was in the form of loans. I woke up this morning wondering something about that. You see, Unity08 has retained a team of boutique DC lawyer-lobbyists to file a lawsuit against the Federal Election Commission in DC District Court. Why? They say in their filings that they’re doing it so that they can obtain the right to take contributions and loans of unlimited size, but that they have no intention of taking contributions of unlimited size, just loans of unlimited size. But if that’s true, then how is it that Unity08 is already taking loans of unlimited size, before any ruling in the lawsuit has been issued? Unity 08 is already doing what it says it needs a court ruling for. So why again has Unity08 filed an expensive lawsuit? Why has Unity08 sued for the ability to do what i
  • Chiquita’s appeal slips farther as lawsuit bruises its sweet image
Chiquita is being sued for funding, arming and supporting death squads in Colombia. The human rights groups EarthRights International filed the class action lawsuit on behalf of six Colombians whose relatives had allegedly been murdered by a Colombian paramilitary group that was partially funded by Chiquita. According to http://www.democracynow.org, the lawsuit alleges that the banana giant funneled money and guns to a rightwing death squad that murdered thousands of people and shipped untold amounts of cocaine to the United States. Chiquita (formerly known as the United Fruit Company) has had a bunch of rotten stories about its history in Latin America.  I found it interesting that this story mentions the Cincinnati Enquirer’s 1998 expose in some detail. Chiquita declined to appear on the program. This report is from http://www.democracynow.org and to read the full report click here. Part of the lawsuit is not in dispute. • Avril drags Apple into lawsuit
Avril Lavigne is being sued by Tommy Dunbar and James Gangwer, who reckon that her single Girlfriend seemed ookily like their 1979 single I Wanna Be Your Boyfriend. Avril's people are denying it, with the sheen of science:The pop star's manager Terry McBride has had musicologists study the two singles and denies any wrong doing by the Canadian singer, commenting: "Avril's a great song writer and she's proving it over and over and over again."He added: "Avril's very, very sensible. She knows music well. If the chords had been similar, the melodies had been similar, lyrics had been similar, the meter, she would have gone, 'Okay, I can see their point.' But nothing's similar."Really? Avril would have responded to a lawsuit by conceding its central claim, would she? Apple will be hoping that Avril is sensible - they've been dragged into the lawsuit on the basis that they sold the track and, uh, something. Which seems weak to us - are record shops supposed to compare every track th

This story got my attention a judge is suing dry cleaners for over his misplaced pants for millions of dollars that I think is wrong and unlawful. Roy Pearson from District of Columbia administrative law judge. He is suing the Chungs the owners of the dry-cleaning business. This nice couple for the past two years they have been dealing with this go to court lawsuit over a pair of missing pants that they found. I am understanding person I can perhaps comprehend him suing over a couple hundred dollars but millions that is just outrageous. The sad thing about this extreme lawsuit that this man is a judge that should know better and be more understanding. This judge should be charged for being irresponsible; it is wrong what he is doing suing for millions because no pants are worth are millions. This man should not even be a judge has no common sense at all; this lawsuit shows his state of mind as person and his judgment as a judge. Update: Dry Cleaner Won Lost Pants Lawsuit A judge rule
